For those wondering the solution for the moment was to go back to WordPress 2.3 until the theme can be fully upgraded to comply with 2.5. Wordpress 2.5 apparently wrote something to the theme during the install. Naki told me using the same theme that was not working in 2.5 also didn't work when it was used in 2.3. My conclusion was something was written to the theme after as the original theme was loaded onto the server and it boot up just fine showing the footer and mybloglog widgets. let this be a lesson to everyone if you have a customized theme you love, always make sure you have a clean safe backup copy.
